DON'T PLAY THEIR GAME Vol. 5 COPS Jonathan's post about law enforcement officials abusing their power has got me ranting and raving and fuming and flaming again. The opinions expressed herein are volitile. You may have fewer rights in your state. Consult an attorney before going outside. This post is long - get a fresh beer or go smoke your cigarette before starting. These guidlines are for all you innocent folks out there who have been hassled by the pigs. If you're already guilty or have just been caught red-handed, these probably still apply, but consult an attorney anyway. I recommend retaining the services of an attorney before committing any crime. When presented with an opportunity to incriminate yourself (there's a cop in sight), here are some guidelines to go by: 1: Cops ALWAYS lie. (ALL cops - even when their lips aren't moving) 2: NEVER tell the cops ANYTHING. (see guidline 1) 3: Never talk about anything on the phone. (see guidline 2) 4: You are innocent untill proven guilty. (see guidline 1) A police officer's job is to gather criminals and evidence for the cases against those criminals. Forget about "Serve & Protect". Police aren't required to protect people, and the Sheriff's department handles serving summons and such. Any cop can, on a whim, cuff you and stuff you in a cell for 72 hours. Once a pig gets it in his pea-brain that you're next, it doesn't matter what you did, if anything. He will find something by illegally searching, or he will make it up. He'll lie, threaten, and otherwise intimidate you to get you to "voluntarily" incriminate yourself. He'll start a fight with you and even beat you up with his stick, just to show you he's right. But cops don't have the last word. The judge/jury must find you guilty before you are guilty of anything. They won't do that if there is no evidence against you. Innocent people don't volunteer evidence against themselves. Cops are used to people giving in to their bullying, evil ways. They aren't used to doing things the right way because usually their victim is as dumb as they are and makes a case against himself before he is even aware he is in custody. But, given the opportunity to screw up, most cops will take a running start. Behave yourself. The police will make fools of themselves trying to incriminate you. In MO, you're required to prove your identity. If the cop wants to know more, you don't have to answer. EVERYTHING you say is evidence against you. The Fifth Amendment says "no person shall be compelled in any criminal case to be a witness against himself". Since we can't be FORCED to incriminate ourselves, the cop will ask you questions so you can "voluntarily" incriminate yourself. ANY answer is evidence against you, so answering must be voluntary. Don't volunteer. The Fourth Amendment states: "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." Always verbally refuse any search. Say "NO." Don't try to give a reason. Anything besides "NO" could be "probable cause". When you tell a cop he can't search, it becomes an issue of "probable cause", which means the cops have to have evidence that a crime has been committed. Not just dubious evidence - they have to swear to it in court, which means their lies become perjury. Cops do not have the RIGHT to search you. They only have the authority to take away your rights when they can prove their case in front of a judge. BEFORE ANSWERING ANY QUESTIONS: ask if you're under arrest. If the answer is no, you are free to go. (I recommend walking away as soon as they say "No".) If the answer is anything besides "you are free to go", you aren't free to go. Say "I don't want to answer any questions without consulting an attorney first." The cop will then attempt to intimidate you. Remain silent (its your right). ARREST begins with "detainment", which is when you are no longer free to go. If you can't walk away, you are already under arrest. Cops will attempt to confuse this line so you have plenty of time to voluntarily incriminate yourself before you are cuffed and read your rights. If you ARE under arrest, repeat after me: "I have the right to remain silent. Everything I say will be used against me. I have the right to consult an attorney. If I cannot provide an attorney, one will be provided for me." At this point, close your mouth and assume "the position". Never resist arrest (unless you are prepared to take on our nation's largest street gang). If you must act with contempt, I suggest responding to all of their questions with "I refuse to participate in your fascist conspiracy. Where's my attorney?" Don't tell the cop ANYTHING untill you have spoken with an attorney. Cops will bully you into an argument. Their intent is to frighten you into defending your position. When you open your mouth to justify yourself, you are incriminating yourself. Keep your mouth shut. The place to address any police issues is in court, never with the officer. The cop will always win the first battle. He will arrest you and take you to jail based on "evidence" he gathers. The cops can hold you for 72 hours before they even have to officially charge you with something. During this time, they will continue to steal your rights from you with lies and deception. The prosecutor has to prove you are guilty. He does this with evidence gathered by the pigs. The pigs will gather ALL "evidence" they can find or fabricate. The "evidence" is then thrown out when your attorney proves the cops acted illegally, unless you open your mouth and give them some "voluntary admission of guilt" to corroborate their circumstancial claims. If there is real evidence, your attorney will tell you. All transactions with police should be handled through your attorney. A "confession" is a legal document you sign after your attorney has negotiated a deal with the prosecutor - NOT something you do in the presence of the lying pigs. You are INNOCENT UNTILL PROVEN GUILTY IN A COURT OF LAW, no matter what the cops tell you. That means if they can't prove their case beyond a reasonable doubt in front of a judge and a jury of your peers, you go free. Don't help them to prove you guilty. Keep your mouth shut. Only say what your attorney tells you to say. Give the cops nothing but your ID and your refusal to waive your rights. Remember - You're innocent untill the judge slams the gavel on you. Innocent people don't volunteer evidence against themselves. The "average" person is confronted by a police officer once every three years. The average police officer is involved in 30 confrontations per day. Each officer encounters close to 20,000 confrontations for each time you have an encounter with a police officer. You aren't better at their game than they are, so DON'T PLAY THEIR GAME! They are trained to INTIMIDATE, LIE, and DECIEVE to manipulate any situation, and they have LOTS of practice. Just shut your mouth and let them put the bracelets on you. If you can beat them, it will be in court. If you can't, at least you're not helping them incriminate you. If the pigs are lying/bluffing, you will win in court. If they're not, you're screwed anyway, so don't make it worse by volunteering evidence. The less evidence they have, the better off you are. EXAMPLE: You get pulled over for your license plate being too dirty (its a law). The cop gets your ID and tells you to step out of the car. At this point, you are "detained" (not free to go - arrested). Everything you say is volunteering evidence. The cop shines his flashlight in the windows of your car and looks around. (This is a legal "security search" to make sure there isn't anything there to harm the officer, like another person with a gun or a bomb. Anything found in a "security search" is evidence.) The cop then asks you what you're doing "driving here at this time of night". You don't have to answer. Any answer is evidence against you. I suggest "I don't want to answer any questions without consulting an attorney first." or "Am I under arrest?" Never lie to the cop. He is the prince of lies, not you. (Lying to a cop is illegal. It is not illegal for a cop to lie to you.) The cop says "Open the trunk." This is a trick. If you do, its voluntary. If a search of the trunk is legally warranted and justified, the cop will open the trunk without your permission. Make them justify their actions in court by refusing to be searched. The cop then opens your car door and begins looking under the seats, in your glove-box, in your ash-tray, etc. If you don't protest, you are "voluntarily" waving your right NOT TO BE SEARCHED. Say "I don't authorize you to search anything." The cop says "Why not? What are you hiding?". He's bullying you into an argument to get you to justify your position and voluntarily incriminate yourself. Remain silent. Its your right.
